RULES AND REGULATIONS

FOR SKY LAKE SOUTH UNITS SIX AND SEVEN

I.COMMON AREA

The installation, removal, trimming or other alteration of any landscaping or plant material located on Common Area is strictly prohibited unless the Owner seeking to install, remove, trim, or alter such landscaping or plant material obtains the prior written approval of the Board of Directors of the Association. Upon approval by the Board of Directors regarding installation of new landscaping or plant material on Common Area, such new landscaping and/or plant material shall become part of the Common Area and as such the Association shall have the exclusive right to maintain and/or remove same at its sole discretion.

II.EXTERIOR MATERIALS AND COLORS

A.No artificial, simulated or imitation plant material or landscaping may be placed on the exterior of a residence on any Lot without the prior written approval of the Board of Directors or its designated committee, the Architectural Control Committee (hereinafter referred to as the “ACC”).

B.No Owner may alter the color of the exterior paint or stain on any portion of his or her residence or on other improvements without obtaining the prior written approval of the ACC after first submitting to the ACC an application containing the proposed color of the paint(s) or stain(s) to be used (including the brand, name and reference number of the proposed color, accompanied by color chart(s) published by the paint manufacturer depicting the true proposed color).

C.By way of guidance, please note that the basic color scheme in Sky Lake South Units 6 & 7 is earth tone or light pastel. Trim color should be neutral.

III.GARAGES, DRIVEWAYS, WALKWAYS, AND SIDEWALKS

A.Carports are prohibited.

B.Painting or staining of driveways or sidewalks is prohibited.

C.Walkways may be painted in accordance with Article II above. Please note that each Lot, including walkways thereon, must be maintained in a neat and attractive manner.

D.Widening of driveways is permitted only under the following conditions and limitations:

(1)The maximum extension of the width of any driveway may not exceed thirty inches (30"); and

(2)No driveway extension may extend beyond the side foundation of the house.

E.Only concrete may be used in the repair of sidewalks or driveways; the use of asphalt or other materials is prohibited.

IV. FENCES

A.As with any other exterior alteration or addition, the prior written approval of the ACC is required prior to installation of any fence. Chain link fences are prohibited.

B.Fencing in the front yard of any kind, including decorative railing or decorative picket fencing, is prohibited.

C.No fence shall be installed in the side yard of any Lot without the prior written approval of the Board of Directors.

D.Fence Specifications:

(1)Pickets -- Maximum width of eight inches (8");

(2)Posts -- Minimum 4" x 4"; posts must be pressure treated and must be located on inside of fence facing the residence;

(3)Fence Height -- not to exceed six feet (6') in height.

(4)Fence types allowed: shadow box, board on board, concrete block, or picket -- only. All fences must be configured to be level and straight.

E.No portion of fence visible from outside the Lot may be painted or stained unless prior approval of the paint or stain color from the ACC is obtained as set forth in Article II above.

V.TRASH CONTAINERS

A.No garbage or recycling containers may be visible from public view at any time except on those days during the week when trash pick-up is to occur at times described below. All garbage and recycling containers kept outdoors shall be placed in an enclosure or landscaped area previously approved by the ACC so as not to be visible from outside the Lot.

B.Garbage and recycling containers may be placed on the street from 6:00 p.m. the day before pick-up and removed no later than 10:00 p.m. on the day of pickup.

VI.LANDSCAPE AND IRRIGATION

A.The minimum requirement for landscaping is that each lot shall be sodded, seeded or plugged with natural grass. Artificial turf of any kind is not permitted.

B.At all times during the year, at least 50% of the total the square footage of the front yard of every Lot must contain live grass. At no time during the year may more than 25% of the square footage of the front yard of any Lot consist of weeds.

C.The landscaping adjacent to all sidewalks, driveways and curbs must be edged.

D.All areas adjoining walls and fences on Lots must be trimmed on a regular basis and must be kept neat and attractive.

E.All beds (defined to mean any area that is not sodded or paved) must be maintained in a neat and attractive manner and free of weeds.

VII.ACCESSORY STRUCTURES, PLAY EQUIPMENT AND DECORATIVE OBJECTS

A.As with any exterior alterations, structures, or additions, any and all accessory structures (e.g. playhouses, play structures, tool sheds, etc.) are prohibited without the specific prior written approval of the ACC.

B.All playground equipment shall be placed to the rear of the residence behind the side and rear lines of the residence or positioned and located so as not to be visible from the street.

C.Clotheslines are prohibited on Lots unless located so as not to be visible from the street.

D.Decorative objects, such as boulders, bird baths, statuary, pedestals and monuments, or other similar structures, are prohibited in front or side yards without prior written approval of the ACC.

VIII.AWNINGS, SHUTTERS, GUTTERS AND DOWN SPOUTS

A.Awnings, canopies, and shutters affixed to the exterior of the residence are prohibited.

B.Hurricane storm shutters may not be affixed to the exterior of any residence without the prior written approval of the ACC.

C.No gutters or down spouts may be affixed without the prior written approval of the ACC; same must match the color scheme of the residence and may not drain at any time onto any adjacent Lot or the Common Area.

IX.EXTERIOR ALTERATIONS AND ADDITIONS

A.Any and all applications to the ACC for exterior alterations and additions must include a set of plans and specifications showing the nature, kind, shape, height, materials, and location of proposed alterations and/or additions and all proposed alterations and additions must be compatible in scale, materials used, and color(s) with the applicant’s residence, other improvements on the Lot, and adjacent residences.

B.Alterations and/or additions may not unduly impair the view or amount of sunlight available to adjacent residences.

C.Additions containing a pitched roof must match the slope of at least one of the existing roof(s) on the applicant’s residence.

D.New windows and doors must match the type and quality of doors and windows throughout the rest of the applicant’s residence. New window and door openings will not be approved if, in the sole discretion of the ACC, the new window and door openings appear to create more entrances and/or windows than are necessary to permit adequate egress from and access to the residence.

E.Any changes in grade are prohibited without the prior written approval of the ACC.

F.Construction materials and equipment must be stored when not in use so as to minimize their visibility from the street. Excess building material and debris must immediately be removed from the Lot and Properties after completion of construction.

G.No major alteration shall be started without the approval of the ACC and an applicable Orange County building or other permit.

X.VIOLATIONS REPORTED

A potential violation may be identified by a member of the ACC, a neighborhood committee, or by any resident of Sky Lake South. If a resident wishes to report a potential violation, he may do so with complete anonymity. Violations should be reported to the Board of Directors or its duly authorized agent. After a potential violation is reported, the Board of Directors or its duly authorized agent will contact a member of the ACC or board members who will personally inspect the item reported and determine whether a violation has occurred.

XI.VIOLATIONS

In the event an Owner or other occupant of a residence is in violation of the applicable Covenants, Conditions and Restrictions for Sky Lake South Units Six and Seven Phases I, II, 3A, or 3B, or these Rules and Regulations, and fails to cure said violation after notification by the Board of Directors or its agent, such Owner or other occupant shall pay for the costs and expenses -- including reasonable attorney’s fees and costs, whether or not suit is filed, and fees and costs from any appeal -- incurred by the Association to enforce correction of such violation(s).

XII. NOTICES

All notices to the Association, or requests for information from the Association specifically including, but not limited to, estoppel letters from lenders and title companies, shall be directed to the Association’s Registered Agent, whose name and address is on record with the Florida Department of State, Division of Corporations, under the following listing:
